Terms of Use

This is a reference translation. The Japanese version is the authoritative text. Where the two differ, the Japanese version governs.
These terms set out the conditions for using gymusic (the “Service”), provided by Daito Iwasaki, trading as AESTIHARMONY (“I”, “me”). By using the Service, you agree to these terms.
1. What the Service is
- The Service is a web tool for building competition floor music for artistic and rhythmic gymnastics, from structural planning through to a final cut at the regulation length.
- The audio is generated by AI. It is not composed by a human composer.
- Planning and chat revisions are free. Audio generation runs on an ElevenLabs account that you hold under your own contract with that company.
- You may also use the Service to trim audio you already have to the regulation length.
2. Accounts
- Using the Service requires signing in with a Google account.
- Under-18s may use the Service, but should do so with a guardian’s consent. Use involves creating an ElevenLabs account and bearing the cost of generation.
- I may suspend or delete an account if these terms are breached, or if the rights of another user or a third party are infringed.
3. Charges
- The Service is free to use.
- The cost of generating audio arises under your own contract with ElevenLabs, and I am not party to it. I add no commission.
- If paid features are introduced in future, notice will be given on the Service beforehand.
4. Your ElevenLabs API key
- Generating audio requires your own ElevenLabs API key.
- The key is stored only in your browser and is never stored on my server. At the moment of generation it is sent from your browser directly to ElevenLabs.
- Keeping the key secure is your responsibility. Do not disclose it to third parties.
- I accept no responsibility for charges arising from a third party using your key.
- If you are on a shared device, remove the key when you have finished.
5. Ownership, and use in competition
- The rights to audio generated through the Service belong to you, subject to the ElevenLabs terms of use.
- Generation on the ElevenLabs free plan is limited to non-commercial use. Professional use — such as producing music for gymnasts you are paid to coach — requires one of their paid plans.
- Whether the audio may be used at a given competition is determined by the relevant federation and organiser. I do not warrant this.
- The Service produces audio at the regulation length, but does not warrant compliance for judging purposes.
- Please confirm compliance yourself before submitting.
6. Audio you upload
- Upload only audio you own or are licensed to use.
- Responsibility for any infringement of third-party rights rests with you.
- Uploaded audio is retained until you delete it. You can delete it from within the Service.
7. Prohibited conduct
You agree not to:
- upload audio that infringes the rights of others;
- access the Service in bulk by automated means;
- attempt to access another user’s data;
- resell the Service itself;
- act unlawfully or contrary to public order and morals.
8. About AI-generated output
- The result may not match your instructions.
- The same instructions produce a different result each time.
- The possibility of a piece resembling another user’s cannot be entirely excluded.
- If the music needs to be fitted to a routine in detail, please consider commissioning a composer (music production).
9. Changes and interruption
- I may change or suspend the Service without notice.
- The Service is offered on a limited basis and stable operation is not guaranteed.
- Changes to, or withdrawal of, external services may render all or part of the Service unavailable.
10. Liability
- The Service is provided free of charge. I do not warrant that it will be fit for your particular purpose, that it will have the functionality, accuracy or usefulness you expect, or that your use of it will comply with any law or competition rule.
- I accept no liability for loss arising in connection with your use of the Service, including deductions or other disadvantage in competition, loss of data, and failures of external services.
- The preceding paragraph does not apply where I have acted intentionally or with gross negligence.
- Where liability does arise, it is limited to ordinary loss and capped at the amount you have paid me (the Service being free of charge, that cap is zero).
- Disputes between you and a third party are to be resolved at your own cost and risk.
11. Changes to these terms, governing law, contact
- These terms may be amended. An amended version takes effect once posted on the Service.
- These terms are governed by Japanese law.
- In the event of a dispute, the parties will first seek to resolve it in good faith. Failing that, the court with jurisdiction over the operator’s address shall have exclusive jurisdiction at first instance.
